Liability Waiver：
1. MINOR GENERAL RELEASE AND HOLD HARMLESS AGREEMENT I acknowledge that participation in the birthday party activities involves certain risks, including but not limited to physical injury, property damage, and other dangers associated with group events and activities. I understand that despite all precautions taken by the organizers, accidents and injuries may occur. In consideration of the Minor’s participation in the Party, by signing this waiver form, I understand and agree, on behalf of myself and the Minor, to the following Assumption of Risk: I acknowledge the inherent risks associated with the Minor’s participation in the Party. These risks may include but are not limited to accidents, injuries or bodily damage, harm that may arise from using engineering tools, equipment malfunctions, improper handling of materials, loss or theft of personal property, or harm arising from other circumstances. While rare, these risks may result in temporary or permanent disability, fatality, or other serious harm. I VOLUNTARILY, KNOWINGLY, AND FREELY ASSUME, TO THE FULLEST EXTENT ALLOWED UNDER APPLICABLE LAW, ALL RISKS AND DANGERS THAT MAY OCCUR RELATED TO THE MINOR’S PARTICIPATION IN THE Party, WHETHER KNOWN OR UNKNOWN (INCLUDING, WITHOUT LIMITATION, THE POTENTIAL RISK OF INJURY), EVEN IF ARISING FROM THE NEGLIGENCE OF MGENIUS ACADEMY OR OTHER. Untitled Title Release and Hold Harmless: In consideration of the Minor being allowed to participate in the Party, I, on behalf of myself, the Minor, and our respective heirs and personal representatives, to the fullest extent allowed under applicable law, hereby release, agree to hold harmless, and fully and forever discharge MGenius Academy, its affiliated individuals and organizations, and their respective officers, directors, managers, members, partners, instructors, staff members, employees, contractors, insurers, agents, and representatives (collectively referred to as “Released Parties”), from any claims, demands, actions, causes of action, injuries or harm (however serious, including, without limitation, temporary or permanent disability or fatality), damages, liabilities, expenses, and costs (collectively, “Injuries”), which may exist now or at any time in the future, arising out of or in connection with the Minor’s participation in the Party. Expressly, I understand and acknowledge that the Minor may suffer or experience, among other things, personal injury or bodily damage, medical disabilities, loss or theft of private property, temporary or permanent disability, fatality, or other harm. I understand, acknowledge, and agree that the foregoing is intended to be, and is, a complete release, to the fullest extent allowed under applicable law, of all Injuries that the Minor may sustain as a result of the Minor’s participation in the Party regardless of the specific cause thereof. I agree, for myself, the Minor, and our respective heirs and personal representatives, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties, which I, the Minor, or our respective heirs or personal representatives, may have as a result of anything released according to this Release, whether or not arising through the negligence, omission, default, or other action, of anyone affiliated with MGenius Academy, including other participants in the Party; and (ii) to indemnify, defend, and hold harmless the Released Parties from all Injuries (including attorneys’ fees) waived hereunder. I acknowledge that MGenius Academy is making no representations or warranties and that I am not relying on such purported representations or warranties. Medical Treatment: In the event of any injury, illness, or accident during the Minor’s participation in the Party, I authorize MGenius Academy and its staff to act on my behalf, including, without limitation, to approve any non-emergency or emergency treatment MGenius Academy or its staff consider necessary, in their sole discretion, and authorize MGenius Academy and its staff to sign any medical releases or required forms on my behalf to the extent permissible under applicable law. I hereby release and forever discharge the Released Parties from any claim arising from any first-aid treatment or other medical services provided to the Minor. I represent and warrant to MGenius Academy that the Minor has no conditions that would make participation in the Party unsafe or have fully informed MGenius Academy of any such underlying conditions and disclaim any liability arising from such pre-existing conditions. I acknowledge and understand that MGenius Academy disclaims any liability related to the Party and that it is my sole responsibility to provide or obtain medical insurance coverage for the Minor. Any costs of medical treatment provided to the Minor will be my sole responsibility and I agree to promptly pay in full any such costs. COVID-19: MGenius Academy takes reasonable preventative measures to decrease the spread of COVID-19, as mandated by the Commonwealth of Massachusetts. MGenius Academy cannot guarantee that I and/or the Minor will not become infected with COVID-19 in connection with the Party. I acknowledge that participation could increase the chance of me and/or the Minor contracting COVID-19 and voluntarily assuming such risk. Compliance with Rules and Instructions: I agree to comply and to cause the Minor to comply with all safety rules, instructions, and guidelines, provided by MGenius Academy instructors and staff members. I understand that failure to adhere to these rules, instructions, or guidelines may result in removing the Minor from the Party. |
